Terms of Service

1. Acceptance of terms

By creating an account or using the Project Succession platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of service

Project Succession provides tools for Jamaican estate administrators, executors, and attorneys to:

• Search financial institution databases for unclaimed funds belonging to a deceased person's estate
• Record, organise, and track estate assets
• Manage probate workflow steps and documentation
• Invite team members (lawyers, beneficiaries) to collaborate on an estate

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent that you have the legal authority to administer or act on behalf of the estate for which you create an account. Creating an estate record for a living person or without proper authority is prohibited.

4. Account responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that all information you enter is accurate to the best of your knowledge
• Immediately notifying us of any unauthorised use of your account

5. Acceptable use

You must not:

• Use the Service to commit fraud, identity theft, or any unlawful act
• Submit false or misleading information about a deceased person
• Attempt to access estate data for which you have not been granted permission
• Reverse-engineer, scrape, or systematically download data from the platform
• Introduce malware or attempt to disrupt the Service

6. Discovery results — disclaimer

Asset discovery results are produced by automated matching against financial institution records and are provided for informational purposes only. We make no representation that:

• A match found belongs to the estate in question
• All assets belonging to the estate have been found
• The stated balances or fund values are current or accurate

You must independently verify any match with the relevant financial institution and seek legal advice before making any claim.

7. Intellectual property

All platform software, design, and content (excluding data you enter) is the property of Project Succession and is protected by copyright. You may not copy, reproduce, or distribute any part of the platform without our written consent.

Data you enter into the platform (estate records, asset details, documents) remains your property. You grant us a limited licence to store and process it solely for the purpose of providing the Service.

8. Limitation of liability

To the fullest extent permitted by Jamaican law, Project Succession shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any loss arising from reliance on discovery results, workflow guidance, or any content on the platform.

Our total liability to you for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your account if you breach these Terms or if we believe continued access poses a risk to other users or the platform. You may delete your account at any time from your settings page. Deletion of an account does not automatically delete estate data if other members remain on the estate.

10. Governing law

These Terms are governed by the laws of Jamaica. Any dispute shall be subject to the exclusive jurisdiction of the courts of Jamaica.

11. Changes to terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
